Problem with Forum Deal (Like New Nashville 112 Amp)

Post by Alden Speirs »

This ad was posted 3/28/09 By Don Reed.

I sent my personal check for purchase of amp 3/28/09 and it was cashed and signed by Don Reed on 3/31/09.
The amp was shipped by Don on 3/31/09 (as per agreement when he received his money) And I received the amp UPS on 4/3/09. Everything excellent! Now on April 13,09 I receive a email from Don saying he did not get the money and wants it now! What am I to think and do about this situation? I will try and upload the copy of cancelled, signed check on here for you to see. Any suggestions?

Maybe the check was hijacked and cashed by someone else. I hope not. When things go wrong it is bad for everyone including all the forumites. I hope you guys get to bottom of this and it has a good ending. Good Luck to the both of you. :) :)

Nashville 112

The seller said the amp would not be shipped until he had his money in hand. Now he is saying he shipped it without getting the money. Hard to figure why anyone would do that after saying "shipment pending receipt of money clearing bank" He had the money before he shipped the item. as per date of transaction on back of check. END OF CONVERSATION.

Is the email you received actually from Don Reed? Maybe someone has hi-jacked your email and it really isn't Don at all!!!!! Happens all of the time including here on the forum!

There are many avenues to explore here as to where the funds actually went. But one thing for sure by your story is you did your part with paying by check and agreeing that the amp would ship after payment clears. If the seller decided to ship the amp prior to this, then that's a bad decision on his part.

Having the cancelled checked paid to and endorsed by the same person is a strong indication that it was properly handled. Most financial institutions will not honor nor handle a check, especially cash a check, without proper identification.

I see no problem on your part as you did exactly what you were suppose to do and received the item you paid for. If there is an identity theft type of situation, then that is not your fault. That is the bank and seller's issue that needs to be resolved.

Having said that, there are people on the forum that I wouldn't hesitate to ship something before receiving the payment as I've done and others have done for me as well. But that comes from being familiar with the person either by longtime association or from previous dealings. Put short, I know they are good for the payment and they know I am good for the payment! You being a new member and not having dealt with you in the past, I would make sure I have the funds prior to shipping. (no offense intended)

I would advise against posting any personal info such as a copy of any documents in which personal info can be obtained, i.e. bank account numbers, SS#, etc. Please realize that there are many people that view the forum as many other sites with the intent to defraud.

Here is your original posting in regards to the amp:

Nashville 112 Like New

Thanks for your input David, I understand that I am a new member and take no offense whatsoever that anyone on the forum would not ship something to me without first receiving the money. That is simple common sense and I expect it. As you say after knowing a person many years and dealing with them many times you would be more trusting, again just common sense.

I spent 7 hrs today in the emergency room with chest pains getting all kinds of tests and come home to receive this depressing email asking for money I already paid and believe me I am a jumble of nerves, here I am at 12:43 am sitting at computer attempting to calm myself. I have done all I can to make this deal ok and I have done no wrong!

For what it's worth,

I ran into a hijacked e-mail issue when I was selling my PODxt a few months back. Played out differently, but it sure had me and the other party pretty confused for a while!

I think the forum is open to anyone isn't it?

I have had 2 checks vanish without a trace in the last 30 days for items purchased here.

To my knowledge they have yet to be cashed.
My bank said if they are still missing more than likly they will be cashed by someone at sometime if a stop payment is not activated on my account. $32.00 to stop payment on a $38.00 item is not to cool for the buyer.
Perhaps we should stop posting our names, address, & phone numbers, etc when we want to buy something.
Do it by email only !!!!!!!!!
If you do not have a secure or locked mailbox anyone can find out where you live and take it from your mail box.
Maybe we should all get a Paypal account and pay the fees. It would have saved me $64.00 over the last 30 days or so.
Now this won't stop the items from vanishing off the front porches.
I try and get a UPS tracking number now and attempt to be home for the delivery.
I hate thiefs.
Just my opinion for what it's worth.

Dan, I am the other party that you were selling the XT to, & I fully agree that mails are hijacked.. I wrote you that I was going to buy it & you recieved a letter stating I wasn't.. This modern computer technology isn't totally honest..

Alden I'm sure things will turn out in your favor. Most of the forumites here are good, honest people.

David, I did send communication to Dan via e-mails, rather than on the forum..

It doesn't add up. If you sent the check to his address and its cashed with his signature that means the bank that cashed your check recognizes him. Ignore it. Its a done deal.

I'd say if you want to extend the benefit of the doubt, which for me always makes me sleep easier, I would proceed like this:

Someone cashed that check - now you need to find out who. The signature on the back of the check is irrelevant - it's the account it landed in that matters.

You can request a copy of that check which will show the imprint from the bank machine that prints the account number and routing number it was deposited to on the back of the check.

With Wells Fargo, you can even see that online with their online banking.

If the money left your account, it went somewhere, and who ever owns that account is in big trouble if it's not the person you made it out to - that's fraud.

Good luck - I'm sorry that's happening to you.

Alden,

I've changed the title of this topic because you are not selling an amp.

I think this is a misunderstanding. You have the amp, and you've paid for it. Just email Don a scan of the canceled check to refresh his memory.

What is the date on the email from Don? Sometimes emails get stalled, and late delivery causes confusion because people don't look at the headers.

I don't think it's wise to post a picture of your check on the Forum. :whoa:

Problem of deal

Post by Alden Speirs »

I want to thank all who responded to this topic. Today I received email from seller with apology and explanation of some mix up on his end. EVERYTHING is Ok and all are happy. I am glad to be able to say that it turned out alright. In todays economy it is hard enough to get a buck without having someone defraud you out of it. We must all be very careful when using the internet. :D :D

:D Don Reed is a good honest person. He played on the Presely's Country Music Show in Branson for 23 years and was recently terminated. Don has some health issues and has applied for disability. Don only lives about 25 miles from me. I have his pedal in my shop for repairs now. I would do like B0B says. You have the amp, and I am sure Don has payment. Posting any bank information on the computer is not wise unless you are prepared for the theifs around the world.

For "some" shows in Branson making loads of money comes first, and the quality of the music comes further down the list of priorities. When possible, Shows replace full time steel men with utility men. Utility men are guys who double on different instruments. Many shows have canned music. Don Reed is a top of the line full time steel guitar player. Any show that cared about the quality of the music would be lucky to have Don Reed on steel guitar. It is about those in control- greed and money. Just my opinion.
