In answer to your post...No, not a criminal...and no crime committed. However, if the ebay seller paid money for it, then he becomes a loser. The (proven) stolen item, once confiscated by police, is always returned to the rightful owner.

Like Jim said this is subjective. I think the melody when supported by good tasteful passing chords is the most important. Most of the time the 'music' is what grabs you...then you pay attention to the lyrics.
