I have to say, after witnessing the many and several dire posts with regard to this subject, that it amazes me how many people are willing to strand the hanging rope without the benefit of so much as one single
first-hand conversation as to the matter at hand.

I've kept my 'cyber mouth' shut thus far, but, as for the rest of you, this thread has kept my attention nearly every day. My mind TRIES to remain open. Ther's NO DOUBT that, at least one side of this issue has a very legitimate complaint. The other side quite likely does, too. Which side is which may vary in the mind of different folks.
The thing that now troubles me most is that there, no longer, is any way BOTH sides can feel truely good about ANY kind of outcome.
Were I in Billy's spot, even if the guitar arrived hand delivered today, each time I sat down behind it would conjur up memories of this sad, sad experience. If I were in the Company's position, I'd know there's no way to totally erase the doubts and anger that so many of us obviously feel.
There POSSIBLY may be some understandable reasons the Company has not sent the guitar and/or explained the facts from their perspective. Ron surely must have wanted this thing to be amicably resolved long ago. He certainly must want the company name to, again, mean what it did under his father's leadership. Who among us would not, also, desire that to be the case???
The Jenkins family seem to be simple, hard working, well meaning people. They wanted something they'd honestly paid for. The Lashley family, at least to most of us, seemed to be reputable, hard working, and quality minded craftsmen. Now, both families have suffered damage.
I have felt the pain of other's, friend or stranger, in the past. Today, there is a deep hurt within me, again. Sad, sad, sad. --Everett

billy? give up? there is no way would i surrender. as u have stated they have promised u this and that which im sure u have written it down or recorded the conversations, or hopefully you have. that should be worth something. if a person is not as good as their word, then they are not worth dealing with, i dont care who they are.
Mr Hess, In my last post what I ment by it was, In my pedal and knee setup, I have 2 LKR and Rebecca called me and wanted to know which one I wanted to the front on the steel, I told her, and then she said she would call me the next day with the shipping info, But that never happened, And when I called them Thursday evening, I was told she was on the phone with another customer, and that she would call me right back,I waited for over 45 minutes ,before I had to leave, but no one called, and when I returned 1 hour later, I checked the caller I.D and there was no call's from North Carolina on it...So thats all their is, back to square one..

I would get in my truck and just show
up at Emmons. Then you will know.
Turn the whole thing over to an attorney
and seek DAMAGES. If you sent money by
US Mail, perhaps even mail fraud charges
could be possible.
This has become a "high profile" thread
as of late. It boggles my ming why the
Emmons Co. does not take care of this.
As already stated earlier, they may
never sell another guitar.

Well - I've been quiet here, too, but have been following this thing with some interest. I keep returning to a couple of key points:
I don't know the particulars of this situation so I don't want to 'reach for a rope' myself, but one thing that continues to bother me is the lack of communication and follow through that seems to be coming from Emmons. Given this difficult situation, if I was a businessperson with an unhappy customer, I would go out of my way to keep him in the loop, to follow through with my stated intentions, and to try resolve the matter to everyone's satisfaction.
I won't even begin to think about who's-liable-for-what regarding orders taken before the transfer of the company, but if Emmons says that they will make things right concerning Billy's up-front payment of cash, then I expect them to do so in a reasonably timely fashion. <u>At the very least, I would expect them to do what they say they will do and if there is a problem or some delay, then I would expect to be so notified - no more, no less.</u>
Again, I don't know all the particulars and I am not in a position to second guess anyone, but I just don't understand why the parties involved would let this potentially damaging thing get blown out of proportion. It can't be good for PR no matter who's right, or what the situation is. Public perception - whether informed or not - can make or break a business.

Maybe legally Bobby, but morally no.
He bought a company that was running, it wasn't a company that had stopped his bussiness, that he restarted. So he took over an enterprise in bussiness, the name virtually unchanged. A normal thing to do would be to check if there are outstanding orders, and subtract an amount from the take over sum.

02/22/02 Just called the Emmons Company, and their wont be any thing shipped in my direction today, She is home sick I was told, and when I asked to talk to Ron, he supposedly wasnt their either, But for sake of arguement, How long does it take to change one knee leaver ???????? Their was only the one knee leaver out of the 6 that was in question.. I guess it takes as long to change one, as it does to set all of them up in the first place....

Billy, I admire & relate to your blind faith. I can't really say anything that hasn't already been WELL said, only that if I were a builder (& praise God I'm NOT!), I would be busting my butt trying to get U in my corner as people like U that desire to believe in a product & its image (whether it exists anymore or not) are slowly going away, which is sad, as I'm sure many of us would enjoy serving a person that "hangs on" like you do. But as one Fourmite stated, "things change", & you may come to the point that you may have to change gears to a company that truly cares for your needs. Change is good for you, but sometimes it just flat out HURTS, & I'm totally with you on that.
Here's my 2 cents: If I were in your position, I would do exactly what Mr. Rick Johnson stated to the letter, then BAIL.
This has also been said before, but I'll just say it again: I want you to have a gtr. NOW, I want you to be pleased with it in all ways, & I want you to enjoy concentrating on more IMPORTANT matters like keeping your chops in shape.

After all this time, a social worker might be thinking that for someone, there must be some enjoyment and pleasure being derived out of this on-going suffering and never-ending complaining about what is a simple legal question. That's what the courts are for. They settle conflicts...... Forums can do little more than hash and rehash the biased points of views of those participating, such as myself.
I chose to purchase my Emmons in the early '70's over all of the other makes/models then available, simply because BUDDY EMMONS had something to do with it. His name assured me that I'd get a good deal.
I will say this, for what it's worth: I wouldn't purchase an Emmons during this life-time whether I have all the facts in this issue, or not. I do not believe that the Emmons outfit has handled this conflict in any manner resembling a business transaction.
Where I once had a definite interest in the outcome of this conflict, I must say, that I no longer care. But, I will NEVER replace my old Emmons P/P with a brand new Emmons as I was seriously considering doing as a direct result of this prolonged battle.
I chose to purchase my Emmons in the early '70's over all of the other makes/models then available, simply because BUDDY EMMONS had something to do with it. His name assured me that I'd get a good deal.

To all of the fellows on the steel forum, I just want to say thank you for your kindness and support in all of this, Mr.Hess..Mr.Ace.. Mr.Hinson..Mr.Montee...Mr.Ramsey and Rick McDonald..and many, many more and To This forum for allowing me to post this matter and with it helping the ordel to come to a very happy ending..
It was just last Sunday at our small church that the pastor got up in church and asked if anyone wanted a prayer cloth for their need's? I took one for my heart condition and also one for them to ship my steel...
I know there is some on here will say, that getting that prayer cloth had nothing to do with it, All I can say I went 9 months without one, and the very next week after getting one, They give us a tracking number... And to Rebecca and Ron I just want to say Thank you for being so kind...
When it get's here I will take some photos for you all to see....

MR.Carlson and Mr.Thomas It is I who should be thanking you and the other fellows on here for all of your support, The Lord said what ever you ask in my name in faith and beliving, it shall be given unto you, And he sure knows me by now,,Because I have been asking everyday for the past 9 months, He didnt say he was going to do it when you wanted him to, Everything has it's time in our Lords plan, and now is the time, Sharon and I are planning on going back into Southern Gospel next year when she hangs her day job up, and I was starting to think with no steel, I was back to playing the Piano, but now it's all gonna work out for the best.
