I'm no expert on copywright laws, however I think if it is not used for commercial gain, i.e. you are selling it for profit or using it in a film, etc. that the Feds will not come knocking on your door. There are a number of attorneys on this site that popped up on the Emmons discussion, maybe they can chime in.

That's one of my favorite LPs; I'd be interested in a copy.

The purpose of a (c)Copyright is to make a legal statement by the owner/author of a piece of intellectual property, that they own the property, and only they have the right to make, or assign others to make, copies of said work. This "Right to copy" in plain English, is to make sure the author gets paid for his/her creation, and has grounds to take legal action if a violation is uncovered.

I applaud your honesty by asking the question. It would be crossing the line to make copies of copyrighted work... even if you claim to make no financial gain. With this said, it is up to the owner of the copyright to protect their intellectual property. You may do it, and the owner may possibly not care, or not want to invest in legal fees to protect their property, or maybe not even find out.

On an Album, the label (ie: RCA) will have a copyright notice, and the author of each song will have a copyright for their song too.

As a final note... YouTube, and many many more websites allow copyright violations everyday. I don't know how protectable a song is in these times without having deep pockets.

This LP had been released on CD in limited distribution (see link below). Not cheap, but the quality of material is excellent.

Oh Well I'm just curious to see how many people would pay such a huge price for any recording regardless of the singer or steel player !!! Do you think this will sell a huge amount of cd's ? Maybe i'm out in left field but i suppose we will see huh ? Laughing

As far as I can tell, the Amazon link simply shows people selling used copies. As to whether they are getting their asking price...your guess is as good as mine. In a free market place, that sort of price tag is justified by nothing more than the greedy hope that someone will pay it (it does not reflect the cost of production). And that sort of price will remove any vestige of concern many people would have about pirating the cd. When you ask for that price you are challenging someone to "go find another one". Problem is, they can just say "ok--my friend will burn me one."

Jon,

Your point is well taken. I'm not convinced there is an easy answer.

No mistake--I am not addressing any ethical aspects. That is a personal thing (I take ethics pretty seriously but try not to lay them on others).
And the law is the law.
I'm just looking at the real world aspect of it.

Jon... I think in the "real world", all or most of use have done things we're not supposed to :-) Any private email requests between Ernie and someone else would not be subject to the scrutiny.

I 100% agree---I was actually going to offer to either burn this for Mark or send him mp3's but it got covered before I got there.

I bought a new copy of this CD just two or three years ago, for less than $20.00. I found it on e-bay. If I remember correctly, it may have been shipped to me from England...
